Affiliate Program Terms

These Affiliate Program Terms (the "Terms") are an agreement between you and Jet Ski Rentals of Miami ("JSRM", "we", "us") and govern your participation in the JSRM affiliate program (the "Program"). By applying to the Program, checking the acceptance box at signup, or participating after approval, you agree to these Terms. If you participate on behalf of a company, you represent that you can bind that company.

1. The Program and our role

JSRM operates a booking marketplace at jetskisrentalmiami.com that connects customers with independent local operators for jet ski, boat, yacht, ATV, and Slingshot rentals in Miami-Dade County, Florida. JSRM is a booking intermediary, not the operator of the activities. The Program lets approved affiliates ("you") share tracked links, QR codes, or referral codes and earn a commission on qualifying bookings. The affiliate portal at affiliate.jetskisrentalmiami.com (the "Portal") is the authoritative source for your current commission amounts, tracking window, minimum payout balance, and payout schedule.

2. Enrollment and eligibility

You must be at least 18 years old, provide accurate and complete information, and keep it up to date. One account per person or entity. We review every application by hand and may accept or decline any application at our discretion. We may ask for changes before approving. Accounts are personal to you and may not be sold, transferred, or shared.

3. Commissions

A commission is a fixed amount per confirmed booking, not a percentage. Amounts are set per listed activity by JSRM and shown in the Portal; we may change amounts prospectively at any time (changes never affect commissions already earned). Commissions are paid out of the JSRM booking fee and are capped by that fee and by the amount the customer actually paid. One commission per cart (checkout), regardless of the number of activities in it.

No commission is earned, and any unpaid commission is void, when: the booking is cancelled, refunded, disputed, or never paid; the booking is your own or made on your behalf (self-referral, including bookings by your household or using your payment methods); the booking is for an activity you operate; the referral resulted from a prohibited method (Section 7); or the booking is a test or fraudulent transaction. If a commission has already been paid on a booking that is later refunded, reversed, or charged back, we may offset the amount against your future balance.

4. Tracking and attribution

Your link or code sets a first-party cookie in the visitor's browser. The tracking window is stated in the Portal (currently 30 days from the click). Attribution is last click wins: the most recent affiliate click before checkout earns the commission, and a later click by another affiliate or another marketing channel replaces earlier ones. Attribution is recorded at checkout only for approved affiliates while the Program is active. Tracking depends on the visitor's browser and settings (for example, cookies being enabled); we are not responsible for attribution lost to blocked or cleared cookies, private browsing, or in-app browsers. JSRM's records are the sole and final basis for attribution and commission calculations.

5. Commission review and payout

Commissions become payable 7 days after the activity date, provided the booking was completed and not refunded, disputed, or flagged for review. We may place commissions on hold while we review unusual activity (for example, repeat bookings from one customer, clicks immediately followed by bookings, or unusually high cancellation rates); held commissions are released or voided after review.

We pay approved balances monthly, on or about the 15th, by the payout method on file (PayPal, Zelle, Venmo, or bank transfer for US affiliates; PayPal only for non-US affiliates), once your approved balance meets the minimum stated in the Portal. Balances below the minimum roll into the next month. You are responsible for keeping your payout details accurate; payments sent to the details on file discharge our obligation. Unclaimed or unpayable balances on accounts closed for violation are void as stated in Section 10.

6. Taxes

US affiliates must provide W-9 information (legal name, address, tax classification, SSN or EIN); non-US affiliates must provide W-8BEN information. Tax identifiers are stored encrypted and used only for tax reporting. We issue IRS Form 1099 where required by law. You are an independent contractor (Section 12) and are solely responsible for your own income, self-employment, and other taxes. We may withhold payouts until a valid tax form is on file.

7. Prohibited methods

The following will result in suspension and voiding of unpaid commissions, and may result in termination:

  • Bidding on JSRM brand terms (including misspellings and brand-plus-generic combinations) in paid search, or using JSRM trademarks in ad titles, ad text, display URLs, or destination URLs.
  • Listing links or codes on coupon, deal, voucher, or cashback sites, or presenting your link as a "discount" that does not exist.
  • Paid ads or accounts that impersonate JSRM or could be mistaken for JSRM.
  • Self-referrals, incentivized clicks, click farms, bots, or automated traffic.
  • Cookie stuffing, forced clicks, iframes, pop-unders, automatic redirects, toolbars, or any technique that sets tracking without a genuine, deliberate click.
  • Spam of any kind (email, SMS, DMs, comment spam) or promotion in unlawful content.
  • Earnings claims or income representations about the Program, or any false or misleading statement about JSRM, the operators, or the activities.
  • Any activity that violates applicable law, platform rules, or these Terms.

We may review traffic quality at any time and request information about your promotional methods; refusing to cooperate with a reasonable review is itself a violation.

8. Required disclosure (FTC)

You must clearly and conspicuously disclose your material connection to JSRM every time and everywhere you share your link or code, as required by the FTC's Guides Concerning the Use of Endorsements and Testimonials (16 CFR Part 255) and any other applicable law. The disclosure must be unavoidable, in plain language (for example "#ad" or the disclosure snippet provided in the Portal), placed with the endorsement itself, not only in a bio, an "about" page, or behind a "more" link. You are responsible for compliance on every channel you use. We may require you to correct or remove non-compliant content, and repeated failures are grounds for termination.

9. Brand assets and limited license

While you are an approved affiliate, we grant you a limited, revocable, non-exclusive, non-transferable license to use the logos, photos, and captions we provide in the Portal, solely to promote JSRM under these Terms. Use them as supplied: no edits to logos, no implying sponsorship beyond the affiliate relationship. You may not register or use domain names, subdomains, social media handles, or app names that contain or are confusingly similar to "Jet Ski Rentals of Miami", "JSRM", or our other brand elements; if you do, you agree to transfer them to us on request at no cost. The license ends when your participation ends.

10. Term, suspension, and termination

Either party may end participation at any time, with or without reason; you can close your account from the Portal. We may suspend or terminate your participation immediately for violation of these Terms, suspected fraud, or risk to the brand, customers, or operators. On termination for violation, unpaid commissions (including approved but not yet paid) are void. On voluntary closure or termination without violation, we pay out your approved balance above the minimum on the normal schedule, and any remainder below the minimum within a reasonable time. Sections 6 and 8 through 17 survive termination. We may modify, pause, or discontinue the Program at any time.

11. Changes to these Terms

We may update these Terms. We will notify you by email at the address on file, and the Portal shows the current version. Changes apply prospectively; your continued participation after notice is acceptance. If you do not agree, stop participating and close your account.

12. Independent contractor; no earnings guarantee

You are an independent contractor. Nothing here creates an employment, agency, partnership, joint venture, or franchise relationship. You have no authority to bind JSRM or the operators, make promises on their behalf, or handle customer payments. We make no guarantee of earnings and publish no earnings claims; any amounts others earn are not a promise of what you will earn.

13. Privacy and data

Click and booking attribution data is processed as described in our Privacy Policy (jetskisrentalmiami.com/legal/privacy/). Your reporting dashboard shows aggregate clicks, bookings, and earnings; you do not receive customers' personal information, and you must not attempt to identify referred customers. If you collect personal data in your own promotion (for example an email list), you are the controller of that data and responsible for its lawful use.

14. Representations and warranties

You represent and warrant that: your application information is accurate; you own or control the channels you listed; your content does not infringe any third party's rights and complies with applicable law and platform rules; and you will perform your obligations under these Terms in compliance with all applicable laws, including the FTC Guides, CAN-SPAM, TCPA, and applicable privacy laws.

15. Disclaimer; limitation of liability

The Program, the Portal, and all tracking are provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, JSRM is not liable for indirect, incidental, consequential, special, or punitive damages, or lost profits, and JSRM's total liability arising out of the Program will not exceed the total commissions paid to you in the twelve (12) months before the event giving rise to the claim.

16. Indemnification

You will indemnify and hold harmless JSRM and its owners, employees, and partner operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your promotional methods, your breach of these Terms, your failure to make required disclosures, or your violation of law or third-party rights.

17. General

These Terms are governed by Florida law, without regard to conflict-of-law rules. Exclusive venue is the state and federal courts in Miami-Dade County, Florida. These Terms, the signup attestations, and the Portal-stated program parameters are the entire agreement about the Program and supersede prior discussions. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the business.
